Mike Portnoy sued Dream Theater after he left group

Here’s some not-so-groovy news: drummer Mike Portnoy sued Dream Theater after he left the group last fall.

Courthouse News Service reports Portnoy, who left the band on his own after failing to convince fellow band members to take a break from the write/record/tour cycle, filed a lawsuit against his former bandmates in April claiming that they “wrongfully excluded” him from the group and continue to “wrongfully using the name of the band in connection with [their] recording of an album without the participation or consent of [Portnoy].”

The suit further alleges that Dream Theater “are wrongfully using the name of the band in connection with the promotion of live performances by the individual defendants, without the participation or consent of [Portnoy].”

The April 27 filing names the Defendants as John Petrucci (guitar), John Myung (bass), Jordan Rudess (keyboards), James LaBrie (vocals), along with associated companies Ytse Jam, Inc. and Infinity Tours, Inc.

Now that the news has leaked, Portnoy says he can’t say a word about it.

“Everyone needs to chill out. Stop feeding into this negative poison on the net... I am legally NOT ALLOWED to speak of business matters, but I'm sure you realize there are two sides to every coin...” wrote Portnoy in a message to fans on Monday. “ If I could openly talk about this stuff and explain the REALITY of everything, I would love nothing more!!! But I am legally unable to discuss it... In the meantime, life is bright and positive...I am happy and so are they....so shouldn't YOU be too??? Don't believe the hype...Carpe Diem!"

Meanwhile, new drummer Mike Mangini has fit like a glove and been extremely well-received by fans during his first summer of shows with DT.

DT's new album, "A Dramatic Turn Of Events," was released this week.

A dramatic turn of events, indeed.

Mike Portnoy needs a break of 2 years or so but he continues to play and make money with other projects and bands. The band did not accept his conditions, it's obvious.
4 people should have waited for him to maybe come back?

Dream Theater have plenty of new ideas and wanted to do a new record. They choose Mangini, which is a better drummer and after this for sure a better person, IMHO.

But the true story is, MP is now so jealous and angry, they did one of the best albums and the next will be even better.Yes, MP, without you. You're angry i understand that.

So, there is nothing left other than trying to make life difficult for DT? ...big, no huge claps for MP. Do you really need this to make a living?

I, as a fan, will never buy a CD or something with the Mike Portnoy name on it starting today, and hope other fans will do the same.

I'm not a fan of you anymore.

Don't know about Mangini being better, they are both great. When it comes to business, however yoou llok at it, he entitled to what's his. Leaving a band regardless of the reason doesn't forfit your copyrights. Pay now or pay later. BTW James Labrie is a queer. Everyone else in Dream Theatre is good though way too much keyboard. Mike=Mike.

Ummm I think yall should get yall's facts straight. This was all cleared up 2 days ago..ofcourse since when does the news do follow up stories on something when they end up being wrong...
